As Landlord disputes are occurring commonly all over America, it is very important for us to know about our rights and duties, both as a landlord and a tenant.

To begin with we can list a few points which say about what a tenant should do. Firstly a tenant should clear off his rent on time. If due to some difficulties he is not able to do so, he must immediately inform his landlord about it, and specify the date by which he would be able to pay. Secondly, he should not see the landlord’s property as something which can be abused. Thirdly, the disposal of sewage materials and garbage should be regularly and properly done. Lastly, one should not violate the written contracts with the landlord. Very often it is seen that a tenant [generally not a permanent resident of the US] lets in his friends to live with him. He does this without informing his landlord and this is a serious offence.

Now, to talk about a landlord’s duties, we should firstly mention that the room\property which the landlord is letting out should be made habitable beforehand. Secondly, he should bear the expenses of ordinary wear and tear and should not thrust it upon a tenant. Thirdly, a landlord should never punish his tenant by disconnecting basic amenities like electricity or water supply, even if there is a landlord dispute. Fourthly, a tenant should be provided with written notice by the existing landlord, before the property is transferred to a new landlord. Lastly, a Landlord should never unlawfully discriminate.

It should be made very clear that even if there is a landlord dispute, the landlord cannot just order his tenant lo leave his house. If the tenant has not adhered to a term of the tenant lease, there is a judicial procedure through which the landlord has to go through to have his tenants evacuated from his property. The landlord should initially paste a 3-day notice on the tenant’s door, which should clearly state the cause of landlord dispute, and should give the tenant a second chance to amend or else he should move out. . The tenant, after getting the notice has 3 days to adhere to the landlords written lease (i.e. should try to resolve the dispute) or else he should leave the premises of the landlord. If the tenant, even after 3 days from getting the notice, remains there but does not care to resolve the landlord disputes, then the landlord can file for eviction in the County Court. The tenant would first be notified of the court date and then, on the assigned date, both the tenant and the landlord would have to go to the court to provide their own reasonable justifications. The judge would then give his judgment for or against eviction. In case, the judge rules for eviction, the tenant should vacate the premises within 48 hours. If the premise is not vacated by the tenant within 48 hours, then the landlord has the option of calling the sheriff and to have a supervised move-out of the tenant’s belonging conducted.

Keeping these facts in mind, we, as tenants or landlords should develop a kind of understanding between us and should not allow any kind of landlord dispute to arise in the first place. Even then, if any kind of landlord disputes arises, .we should try to resolve it through mutual understanding and cooperation, before taking a legal aid. And we should, in no circumstances take the Law in our own hands.
